Terms and Conditions — Poda

1. Who provides the service
Poda is operated by Daniel J. Marín, based in Puerto Rico. Contact: marin.danielj@gmail.com.
2. What's sold
Poda sells fixed-scope automations ("podas"), each described on its own product page — fixed price, delivered within 10 business days of the kickoff call, with a defined scope that excludes anything listed under "What this doesn't include."
3. How payment works
Payment is charged in full, upfront, at the time of purchase — before the kickoff call. This reserves your spot in the build calendar without prior negotiation.
4. Refund guarantee
If the kickoff call shows you don't meet the technical requirement for the poda you bought, you're refunded in full that same day.
If the requirement is met and you choose to cancel after the kickoff call, the refund depends on timing:
- Days 1 through 5 (counted from the kickoff call): 50% refund.
- Day 6 onward: no refund applies.
If you don't book the kickoff call within 48 hours of purchase, or book and don't show up without rescheduling within the following 48 hours, you're refunded in full automatically and your batch slot is cancelled. Resuming the service requires starting the purchase process again.
5. What you own
You own your data and the final automation built for your business. Poda retains the right to reuse the underlying mechanisms, templates, and generic components with other clients — we don't sell exclusivity over the type of solution, only over your specific configuration.
If you modify the automation on your own after delivery, Poda isn't responsible for any effects that modification may cause. The 30-day support window (clause 7) covers adjustments made by Poda to the delivered version, not to client-modified versions.
6. Access to your systems
During the build, Poda may need temporary access to your business systems or data. That access is used only for the agreed work, never shared with third parties, and revoked after delivery unless an active retainer is in place.
7. Support after delivery
Every poda includes 30 days of adjustments after delivery. After that, further support requires a retainer or a new poda.
8. Limitation of liability
Poda isn't responsible for indirect damages, lost revenue, or consequences from using the automation beyond a refund of the amount paid.
9. Governing law
These terms are governed by the laws of Puerto Rico.
